Terms of service

Last updated 9 September 2026

These terms govern use of qScreen, an assessment platform operated by Codestack Consulting Limited (“we”, “us”). Where we have signed a separate written agreement or order form with a customer, that agreement takes precedence over anything here that conflicts with it.

1. The service

qScreen lets a customer build assessments, invite candidates, run those assessments in a browser, mark the submitted code automatically, and read the results. We provide it as a hosted service unless the customer has agreed with us to run it in their own infrastructure.

We may improve, change or withdraw features. Where a change materially reduces what the service does, we will tell customers in advance.

2. Accounts and access

  • Accounts are for named individuals. Do not share credentials between people.
  • The customer is responsible for what is done under its accounts, and for removing accounts of people who leave.
  • Tell us promptly if you believe an account has been compromised.
  • Roles determine what an account can see. An account restricted to one client organisation cannot see another’s data, and attempting to circumvent that is a breach of these terms.

3. Acceptable use

You agree not to:

  • use the service to assess anyone without a lawful basis for doing so, or in a way that breaks employment or discrimination law where you operate;
  • attempt to escape, subvert or attack the assessment sandbox other than through a vulnerability report to us;
  • probe, scan or load-test the platform without our written agreement;
  • attempt to reach another customer’s data;
  • resell or provide the service to a third party unless your agreement with us permits it;
  • republish or redistribute the platform question bank outside your own assessment process.

Candidate code submitted through the platform is executed in a sandbox. We may suspend access without notice where we reasonably believe continued use threatens the security or integrity of the platform or another customer’s data.

4. Candidates and personal data

The customer decides who is assessed and why, and is the data controller for candidate personal data. We process it on the customer’s instructions as a processor. The privacy policy describes what is held, where and for how long, and forms part of these terms.

The customer is responsible for telling candidates that they are being assessed and what happens to their result, and for having a lawful basis for the assessment.

The platform records process signals — timings, keystroke and character counts, paste lengths — as evidence for a human reviewer. It does not produce a cheating verdict, an integrity score, or any automated decision about a candidate, and customers must not present it as one. Hiring decisions are the customer’s, made by people.

5. Content and intellectual property

  • Ours. The platform, and the platform question bank supplied with it, remain ours. You get a non-exclusive right to use them for your own screening for as long as your subscription runs.
  • Yours. Questions and assessments you author, and your customer data, remain yours. You grant us only the rights needed to host and operate the service for you.
  • Candidates’. Code a candidate submits is held for the customer’s assessment purposes. We do not use it to train models or for any purpose other than providing the service.

6. Fees

Fees, billing period and any usage limits are those set out in the written agreement or order form between us. Unless that agreement says otherwise, fees are payable in advance and are not refundable for a period already begun.

7. Availability and support

We aim to keep the service available and to respond promptly to problems, and we will arrange planned maintenance to avoid disruption where we reasonably can.

We do not offer a contractual uptime guarantee or service credits under these standard terms, and we would rather say so than publish a figure we do not measure against. If you need a service level commitment, it can be agreed separately in writing.

8. Third-party services

The service depends on hosting and email providers listed in the privacy policy, and on the kdb+/q runtime used to mark answers. kdb+, q and KDB-X are trademarks of KX Systems, Inc.; we are not affiliated with or endorsed by KX. Customers using their own licensed KX binary are responsible for holding a licence that permits that use.

9. Warranties and disclaimers

We will provide the service with reasonable skill and care. Beyond that, and to the extent the law allows, the service is provided as is: we do not warrant that it will be uninterrupted or error free.

An assessment result is one input into a hiring decision and nothing more. We make no representation that a score predicts job performance, and we are not responsible for hiring decisions made by a customer.

10. Liability

Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be limited.

Subject to that, neither party is liable for indirect or consequential loss, or for loss of profit, revenue, goodwill or anticipated savings; and our total liability arising out of or in connection with these terms is limited to the fees paid by the customer in the twelve months before the event giving rise to the claim.

11. Term, termination and your data

Either party may terminate as set out in the applicable order form, or on thirty days’ written notice where none applies. We may suspend or terminate immediately for a material breach of clause 3.

On termination the customer may ask, in writing, for an export of its data or for its deletion, and we will carry that out. Deletion is performed by a person rather than by an automated routine; we will confirm to you when it is done.

12. Confidentiality

Each party will keep the other’s confidential information confidential and use it only to perform these terms. Assessment questions, candidate submissions and results are confidential information.

13. Changes to these terms

We may update these terms. Where a change is material we will give customers reasonable notice, and the updated date at the top of this page will change.

14. Governing law

These terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction.
